Setback For Penn State Officials Seeking Dismissal Of Charges

HARRISBURG, Pa., (CBS) - A judge has dealt a setback to Penn State's former president and two former administrators seeking the dismissal of charges stemming from the Jerry Sandusky scandal.
Three former Penn State officials – President Graham Spanier, Athletic Director Tim Curley, and Vice President Gary Schultz -- have been charged with perjury, obstruction and other offenses for their alleged mishandling of reports involving Jerry Sandusky's behavior with children.
Defense attorneys for the three men had questioned the role of former Penn State counsel Cynthia Baldwin, arguing that the defendants believed that Baldwin was representing them when they appeared before a grand jury investigating the case, and that her testimony should be disallowed.
But a judge in Harrisburg has now denied defense motions, including a motion to quash the grand jury's presentment, and a motion to quash Spanier's testimony before the grand jury on the grounds of Baldwin's alleged conflicts.
