Sandusky's Attorney Files Motion To Dismiss Charges

HARRISBURG, Pa. (CBS) - Jerry Sandusky's lawyer has filed a motion seeking dismissal of child sex abuse charges against his client.
As expected, Sandusky's attorney made the argument that many of the charges against the former Penn State assistant football coach involving 10 alleged victims should be dismissed because, lacking precise dates and locations, they are "so general and non-specific that the defendant cannot adequately prepare a defense to those charges."
With regard to charges involving victim 2, the assault allegedly witnessed by Mike McQueary, the motion contends the prosecution cannot sustain the charges at trial based on McQueary's testimony.
It also claims insufficient evidence to sustain charges involving victims 6 and 8. The motion raises other issues, including the contention that the statute of limitations has run out on many of the charges.
Sandusky's attorney also asks again to delay the start of the trial, scheduled for mid-May.
