Sandusky Tries Again For Dismissal of Penn State Sex Abuse Charges
BELLEFONTE, Pa. (CBS) -- Onetime Penn State assistant football coach Jerry Sandusky is once again asking the judge presiding over his case to dismiss child sex abuse charges against him.
Sandusky had previously filed a motion to dismiss the charges against him, saying they were too vague as to dates, locations and other specifics, or that they lacked evidence.
But during a hearing last month, the judge said the case was "in flux" and that the motion was premature. Then, several days later he dismissed the motion "without prejudice," leaving the door open for Sandusky to revisit the issue.
And now Sandusky's lawyer has filed a new motion seeking dismissal of the charges.
The start of Sandusky's trial is now less than three weeks away, although the defense last week filed another motion seeking a delay of the June 5th start date.
