New Trial Date Set For Pre-Teen Charged In Violent Home Break-In in Juniata

PHILADELPHIA (CBS) -- The trial has now been rescheduled for a 10-year-old Philadelphia boy accused in an alleged home invasion attack last month on a 51-year-old woman in the Juniata Park section of the city.
The case was postponed in Family Court because the prosecution asked for a few more days for police to determine if anyone else, juvenile or adult, was involved in the August 6th incident.
The combination of a deadline to share evidence with the defense, one lawyer's coming vacation, and the other's jury duty pushed the trial date back to September 25th.
A second issue was whether the young suspect should still be held in juvenile detention. His godfather offered to allow him to stay at his home in Holmesburg, miles from the scene of the crime.
Judge Kevin Dougherty refused the request for house arrest, citing the seriousness of the charges and the fact that the godfather had little experience dealing with the suspect in the past few years.
