New Jersey Supreme Court To Hear Same-Sex Marriage Case

TRENTON, N.J., (CBS) -- New Jersey's Supreme Court will have the final say on whether same-sex marriage will become legal. The high court will also decide whether to stay a Superior Court judge's order requiring the state to start issuing same-sex marriage licenses in little more than a week.
Chief Justice Stuart Rabner signed a two page order putting the issue on the fast track. Briefs from both sides are due on a schedule that concludes on December 3rd. Oral arguments will be heard just after the new year.
The justices will also take a look at the Christie Administration's request to stay Judge Mary Jacobson's order requiring same-sex marriage licenses be issued as of October 21st. That bid had been filed with an appellate judge in Atlantic County. The direct certification order does not indicate when a decision on the stay might come down from the high court.
