Judge Denies Sandusky Request For Delay In Trial

HARRISBURG, Pa (CBS) -- The judge presiding over the Jerry Sandusky case has denied a defense motion to delay the trial, scheduled to start in mid-May.
Earlier this week, Sandusky's attorney asked that the trial be delayed for two months, citing among other things, the volume of documents that have to be reviewed, and the need to locate and interview witnesses.
The defense also said some key witnesses won't be available to testify in May.
But the judge said the trial is still 10-and-half weeks off, and that "delay has a way of begetting delay."
In other words, the judge said in his ruling that at this point, there is no assurance that approving a delay of the trial now won't give rise to more issues prompting a request for still more delay.
The judge said postponing the trial should be a last resort, and so for now, he's denying Sandusky's request to delay the trial until mid-July.
The judge did grant a defense motion for more time to file a pre-trial motion.
