Jenkintown Mayor Under Investigation For Reports Of Underage Drinking
EDITOR'S NOTE: The Montgomery County Detective Bureau's investigation found no evidence that would warrant criminal charges against the Foleys related to this incident and no charges were filed, according to Kate Delano, Director of Communications for the Montgomery County District Attorney's Office.
JENKINTOWN, Pa. (CBS) -- The Montgomery County District Attorney's office is investigating a case of underage drinking that may have occurred at the home of the mayor of Jenkintown.
Mayor Ed Foley said through his attorney that he has done nothing wrong.
"Not only were they [the Foleys] not serving alcohol, they didn't know the teenagers were drinking it there," said attorney Emmett Madden. "It's my understand that some of the teens were drinking before they got there, they may have been drinking there, and they were drinking after they left. But any drinking they were doing, they were doing covertly."
The incident began during the early hours of Saturday, April 16, when a Jenkintown police officer spotted two teenagers on West Ave. trying to help a third teenager, who appeared drunk, get home. The drunk teen had to be taken in an ambulance to Abington Hospital for treatment.

When the police officer asked the teens where they had been, they told him they were at Mayor Foley's home.
Madden confirms the Foleys hosted a party for about 30 teenagers that evening, but they were unaware any teens were drinking. The teens stayed largely outside the home.
Madden says the teenagers left the Foleys home about an hour and a half before they were picked up by police.
Jenkintown Police turned the investigation over to Montgomery County detectives to avoid a conflict of interest. In Pennsylvania boroughs like Jenkintown, the mayor oversees the police department.
