First Lawsuit Filed In Philadelphia Train Derailment

PHILADELPHIA (CBS) – One of the victims from Tuesday's Amtrak train wreck files the first lawsuit against the company in connection with the crash.
Bruce Phillips is an Amtrak dispatcher from Philadelphia.
He was on his way to work in New York when he sustained massive injuries in the wreck.
"Head trauma. I know he injured either one or both of his lungs. They're still testing him. He's injured his neck, his low back, his knees. So he hasn't even had the opportunity to really learn how to walk again," said Philips' attorney Robert Myers.
Myers says they are filing their case in United States District Court in Philadelphia for an unspecified amount of money.
"We brought this lawsuit on his behalf, not only for common law negligence claims but for a claim which allows injured railroad workers to bring a suit for lost wages and pain and suffering against their railroad employer due to the railroads negligence," said Myers.
In an emailed statement, Amtrak says they do not comment on pending litigation.
