Father, 2 Social Workers Found Guilty In Danieal Kelly Starvation Death Case
PHILADELPHIA (CBS) - A Philadelphia jury has found a father and two social service agency workers guilty in connection to the neglect and starvation death of Danieal Kelly, 14, who weighed just 42 lbs. when she died. All three defendants had pleaded not guilty.
Prosecutor Jennifer Selber told the jury Daniel Kelly was a cruel, abusive and neglectful father who did not want to care for his profoundly disabled daughter and ultimately abandoned her to her unfit mother. A mother who watched Danieal die.
Defense attorney Earl Kauffman called the prosecution's allegations nonsense. Kauffman said Daniel Kelly tried to see Danieal, but the mother wouldn't allow it.
Jurors did not agree and found Daniel, 40, guilty of endangering the welfare of a child.
Dana Poindexter, a 54-year-old former DHS intake worker, was also found guilty of endangering the welfare of a child, recklessly endangering another person and perjury.
The prosecution said Poindexter took the initial reports, but ignored repeated reports of abuse and neglect.
Mickal Kamuvaka, 62, who ran the private social service agency that was supposed to be providing care for Danieal, was found guilty of endangering the welfare of a child, involuntary manslaughter, tampering with evidence, perjury, forgery, reckless endangerment and conspiracy.
Sentencing for all three defendants is set for September 6, 2011.
Danieal's mother is already serving a 20 to 40 year sentence in this case after pleading guilty to murder.
