Defendant In Bucks "Snow Rage" Case Will Plead Guilty To Misdemeanors
BUCKS COUNTY, Pa. (CBS) - A deal has been cut between prosecutors in Bucks County and a Bensalem man charged with threatening another man who was clearing snow from a parking lot last week.
Eddie Simmons, 26, got upset with a worker clearing snow at the ARK apartment complex since his car was getting plowed in.
He pulled out a gun and threatened the worker with it, concedes Simmons' attorney, Craig Penglase (see previous story).
"What most people don't realize is that in Pennsylvania , simply pointing a loaded firearm is not typically an aggravated assault, which is what was charged in this case," said Penglase.
In return for waiving a preliminary hearing, prosecutors have dropped two felony counts against Simmons. Plans are for him to plead guilty to four misdemeanors when the matter gets before a Common Pleas Court judge in Doylestown in mid-March.
For now, Simmons remains behind bars, and Penglase will argue after the guilty plea is entered that his client should be sentenced to time served -- even though he'll never be able to legally possess a handgun again.
