Commonwealth Files Response To Motion, Sandusky Trial Postponed 3 Weeks

BELLEFONTE, Pa. (CBS) -- The Commonwealth has now filed its response to Jerry Sandusky's motion to dismiss child sex abuse charges against him, as the judge in the case postpones the start of the trial until early June.
Last week, Sandusky's lawyer filed a motion claiming the alleged criminal acts are so lacking in specific dates, times and locations that his client cannot adequately prepare a defense to them or that there's insufficient evidence.
In its response, the prosecution points out that Sandusky waived his preliminary hearing, thus conceding there is sufficient evidence to bring the case to trial.
The prosecution, saying it has broad latitude when attempting to affix the date of offenses which involve a continuous course of criminal conduct, especially involving sexual offenses against children, suggests the defendant is attempting to "exploit the appalling breadth of this own criminal conduct" by claiming that it hampers his defense.
The prosecution also denies that the statute of limitations has expired.
The judge, meanwhile, has postponed the mid-May start of the trial by three weeks.
