United States District Court Judge Eric Melgren ruled Wednesday that the federal Election Assistance Commission could not reject requests from individual states to add specific instructions to their national voter registration form.

Kobach says the ruling should clear the way for states to implement voter identification.

"States have the Constitutional authority to control the qualifications of voting, and that means enforcing those qualifications. And this federal agency that was refusing to change the federal form did not have the legal authority to tell us no. This is a big victory for States' rights, a big victory for those states that are trying to do something to stop the abuses of our election system," he said.

Kobach believes this court decision could have ramifications in the battle over the use of photo ID in Pennsylvania.

"If the Pennsylvania Legislature in the future wants to follow Arizona and Kansas and the other states which have proof of citizenship, which again, really does cut down the number of people that are on our voter rolls but are not U.S. citizens, then you have an open door to do that," he stated, adding that subsequently, there will be lower amounts of voter fraud.

"This is a big deal," Kobach said, citing examples of voter fraud in recent years. "It happens all over the country. Sometimes, the aliens don't even know they are doing anything wrong -- their employer is just telling them to do this, or somebody in their community is telling them to do this, and they get manipulated. But the bottom line is, that's how elections are stolen, and every time an alien votes, it cancels out the vote of a U.S. citizen."
