Attorney General Kane Is Victim Of "Selective And Vindictive Prosecution," Lawyers Claim
NORRISTOWN, Pa. (CBS) -- Attorney General Kathleen Kane is the subject of "selective and vindictive prosecution." That's according to the latest motion filed by her lawyers in Montgomery County court in her fight against criminal charges alleging she leaked secret grand jury information and then lied to cover it up.
The motion, which Kane's lawyers tried unsuccessfully to file under seal, says charges must be dropped because leaks of secret grand jury information are not uncommon, yet prosecutions for such leaks are extraordinary.
It says Kane became the target of the criminal investigation in part because she was critical of how Frank Fina and Marc Costanzo handled the Jerry Sandusky investigation while with the Attorney General's Office. Also, it says, the two targeted her because they were concerned about pornographic emails they had received or sent.
The motion claims the two prosecutors convinced a judge to appoint a special prosecutor to investigate the leaks from a 5-year-old case, yet they didn't investigate similar leaks of other high-profile investigations, such as Sandusky or Bonusgate.
