Graham Case Going To Grand Jury
CENTENNIAL, Colo. (CBS4)- The Arapahoe County District Attorney's Office has confirmed that a grand jury that begins its term Jan. 20 will be asked to consider investigating the 2009 murder of Andrew Graham, 23.
Casamir Spencer, a spokesperson for Arapahoe County District Attorney Carol Chambers, said she could not elaborate or explain why the D.A.'s Office has elected to take the case to a grand jury.
Graham was found dead the morning of Nov. 6, 2009 in the front yard of a Centennial home. He had been walking home from a nearby light rail station when he was fatally shot in what investigators have theorized was a random, racially motivated attack perpetrated by a group of as many as five Denver gang members.
No one has been charged in connection with the Graham killing.
By phone Thursday, Arapahoe County Sheriff Grayson Robinson said he was pleased at the district attorney's decision to have a grand jury consider the case.
"This has been a case where we believe going to the Grand Jury is the right decision and supports our efforts to bring suspects to justice," said the Sheriff.
Andrew Graham's mother, Cyndi Gelston- Graham, told CBS4 prosecutors had briefed her in recent days, telling her if the grand jury takes the case, their probe could take six months or more.
"I'm glad they're moving forward," said Gelston- Graham. "But I'm not going to say there will be any closure because of it. We'll see what happens."
A grand jury investigation would allow prosecutors to get reluctant witnesses to testify in secret and offer immunity to key figures who may have critical information.
