Colorado Springs Teen Found Guilty Of Trying To Kill Mother

COLORADO SPRINGS, Colo. (CBS4)- Jurors in the cast of a Colorado Springs teenager accused of killing his younger brother and trying to kill his mother, were not able to reach a decision on all charges.

Daniel Gudino, now 14, was found guilty of first degree attempted murder, assault, prohibited use of a weapon and illegal discharge of a weapon.

Jurors were not able to reach a decision on the most serious charge of first degree murder for the killing of Daniel's younger brother, Ulysses.

In May 2009, police in Colorado Springs said Daniel, who was 13 at the time, picked up his father's rifle and shot Ulysess three times. The teen is also accused of stabbing his mother Marina, who survived.

Defense lawyers said Daniel might have been sleepwalking at the time of the shooting. They said Daniel described the scene as a dream and said that he was shooting at ghosts.

Sentencing for Daniel is scheduled for April 6. Daniel's parents have asked that their son be sent to a facility where he can receive treatment for mental health problems instead of going to jail.
