Broncos Rookie Cox In Court On Sex Assault Charge

CASTLE ROCK, Colo. (AP) ― A judge is being asked to decide whether Denver Broncos cornerback Perrish Cox will be allowed to leave Colorado while sexual assault charges are pending against him.

The rookie was in a Douglas County courtroom for a hearing Friday. He walked into court with his sister by his side.

Cox was arrested Dec. 9 and is free on $50,000 bail. He wants to be able to return to his hometown of Waco, Texas now that the Broncos' season is over.

A judge refused a request by the media to unseal an arrest affidavit, which contains details of the alleged assault.

"We are disappointed," said Steven Zansberg, the attorney representing the Associated Press, The Denver Post, and New York Times.

Cox faces two felony sex assault charges. He is accused of having sex with a woman while she was physically helpless, that he knew the victim was helpless, and that Cox was aware the victim was incapable of appraising the nature of the victim's conduct.

"The judge found that the public's interest in knowing this information outweighed by the fair trial rights of the defendant and the privacy rights of the victim and the defendant," said Zansberg.

"I'm happy with every judge's ruling and I'm happy with the judge's ruling today," said Cox's attorney Harvey Steinberg.

The alleged victim, whose name has been redacted from court documents, has hired Denver radio talk show host Craig Silverman as her attorney. He has asked the court to respect her privacy.

"I spoke in court and I'm gonna leave it at that for now," said Silverman.

The next court appearance for Cox is his preliminary hearing in March.
