PHILADELPHIA (CBS) --  Police charged the driver of an SUV they say jumped the curb, and killed Rosa Lydia Rojas in Port Richmond.

Police say 39-year-old Ryan Patrick McHugh has been charged with vehicular homicide, involuntary homicide, DUI, Aggravated Assault By Vehicle While DUI, Accidents Involving Death Or Personal Injury, and a list of other charges.

Bail also been set to $150,000.

Rosa's father, Eugenio Rojas, has been keeping vigil in the spot where his daughter and grandson were hit along Aramingo Ave -- near East Tioga Street.

Police sources say the driver, who is from Northeast Philadelphia and whom they say was high at the time of the crash, plowed into the mother -- who was with her two children about 9 p.m. Saturday.

Police say the car rolled over her, and she was pronounced dead a short time later.

Her nine-year-old son, Jaden, broke his leg after he, too, was hit.

He is recovering at St. Christopher's Hospital for Children.

Jaden has not been told his mother passed away, according to family.

Rosa Lydia's daughter witnessed the crash -- and a crowd of people quickly gathered to make sure the driver wasn't successful in running away.

Rosa's father says he will stay out here, to demonstrate he wants justice for his late daughter.
