Texas House To Vote On Bill Limiting Eminent Domain
AUSTIN (AP) - The Texas House is debating a bill that would limit the ability of governments to seize property using the power of eminent domain.
Under the proposed law, property could be seized under a process called "eminent domain" only it if would be put toward public use. The government would also be required to make a "bona fide" offer to buy the property. A vote is expected Wednesday.
Lawmakers have been tinkering with the state's eminent domain law for years as concern mounted about governments abusing their power to seize private land. Gov. Rick Perry, a Republican, has designated the eminent domain bill a legislative emergency.
Perry vetoed a similar bill in 2007, saying it would cost too much taxpayer money in potential litigation. He has supported other efforts.
