Nanny Accused Of Murder On Trial For 2nd Time
McKINNEY (CBSDFW.COM) - A nanny accused of murdering a 14-month-old boy is going on trial for the second time. A jury has been selected and opening statements are scheduled to get underway on Tuesday morning at the Collin County Courthouse in McKinney.
Ada Fernandez was originally convicted of murdering 1-year-old Kyle Lazachik in 2006. The toddler died after suffering severe head injuries back in October 2005. The 33-year-old nanny said that it was an accident, but prosecutors in the first trial painted a very different picture. They argued that Fernandez killed the boy by beating his head against a kitchen cabinet.
The jury convicted Fernandez, and the little boy's mother told the defendant in court that she was a baby murderer.
But the Fifth District Court of Appeals overturned the initial conviction, saying that there were two errors in the first trial. The Collin County District Attorney's Office decided to try the case again.
