Midland Train Crash Victims Blame Union Pacific
MIDLAND (AP) - Survivors of last year's deadly West Texas train collision who are suing Union Pacific Co. say the railroad should not be able to claim that Midland and Midland County are responsible.
The Midland Reporter-Telegram reports the plaintiffs say Union Pacific hasn't presented facts to support its claim that the city, county and parade organizer be designated as responsible third parties.
The company has said those entities failed to exercise "ordinary care" in planning the Nov. 15 parade that resulted in the deaths of four military veterans and left 16 others injured. The veterans were riding on a flatbed truck that was hit by a train traveling 62 mph.
Lawsuits filed in Dallas and Midland claim Union Pacific was negligent.
The response from victims was filed last week.
