EL PASO (CSBDFW.COM) — The attorney for a man charged with capital murder in an El Paso police officer's traffic death says his client didn't intend to hit the officer with his vehicle.
The El Paso Times reports 45-year-old John Paul Perry pleaded not guilty during a court hearing Tuesday.
Investigators allege Perry deliberately hit a motorcycle driven by Officer David Ortiz on March 10. Ortiz died four days later.
Defense lawyer Joe Spencer said Tuesday there was nothing intentional in this accident "and I believe that the evidence will show that."
Perry remains jailed without bond. Court records show Perry has numerous convictions.
Prosecutors Rebecca Tarango and Amanda Enriquez said during the hearing that no decision has been made on whether the state will seek the death penalty.
