DALLAS (CBSDFW.COM) -  The last person to talk to the man shot by a tow truck driver in Dallas is now talking exclusively to CBS11.

Jeffrey Grant is a juvenile probation officer and he was with co-worker, Lance Lemons, moments before he was killed.

Grant didn't witness the shooting, but he says his friend had just left his apartment and lemons would have had no need to steal the tow truck.

The 27-year-old was shot and killed at the flats at Five Mile Creek Apartments..

Dallas police say the tow truck driver left his truck running and unattended.

Family members now believe lemons got into the tow truck to move it out of the way so he could go home.

"Lance is a giving guy. He'll give you anything before he'd take anything. That's him. That's why he worked with the kids," explained Lemons' co-worker Jeffery Grant.

"I know now he's smiling, knowing his dad has figured things out. He's in a better place. He just beat me there. I thought I'd beat him there. But he beat me there. 53 We've always competed with each other, no he done beat me again."

The family has hired a private investigator.

They want the community to know their son was a leader in athletics and mentored others through civic organizations and their church.

Police say the investigation is still pending and the name of the tow truck driver has no been released.
