Jones Attorneys Argue Assault Claim Filed Too Late

DALLAS, Texas (CBSDFW/AP) - A judge won't be ruling on the timeliness of a sexual assault lawsuit against Jerry Jones until next month.

Jones attorneys have argued that the Oklahoma woman waited too long to file a lawsuit accusing him of sexual assault.

State District Judge Dale Tillery did not immediately rule Friday on whether a Texas statute of limitations prevents Jana Weckerly's lawsuit from proceeding.

Weckerly's attorney, Thomas Bowers, argued that she was paid hush money for at least four years after the alleged 2009 assault, creating a conspiracy to silence her that remained active.

But Levi McCathern, one of Jones' attorneys, deny there was a assault and denied any payments were made -  and said that even if they were, Weckerly wasn't under any pressure to take them.

McCathern, now finds himself named as a defendant in the suit by a former stripper who says she was assaulted then paid hush money.

The next hearing in the case is scheduled for Oct. 16. Weckerly is seeking damages of more than $1 million.
