Irving Mom Arrested After 3 Children Drown Sues For Survivors

IRVING (CBSDFW.COM/AP) — A suburban Dallas woman who was arrested after three of her children drowned in June at an apartment complex pool has filed a federal lawsuit seeking the return of her two surviving children and $2 million in damages.

The Dallas Morning News reports that Patricia Allen claims in the suit against the Dallas County Child Protective Services that the agency violated her 14th Amendment due process rights.

An agency spokeswoman said the agency couldn't comment on the lawsuit. She referred questions to the Texas Department of Family and Protective Services, which also declined to comment.

About two weeks after the drownings, Allen was arrested and charged with injury to a child, a second degree felony punishable by two to 20 years in prison.

She was released one day later.
