Fort Worth Man Connected To Two Shootings Has New Chance To Get Out Of Jail
FORT WORTH (CBSDFW.COM) — A Fort Worth man accused of shooting his neighbor and his girlfriend weeks apart from each other, now has a chance to get out of jail.
Judge Chris Wolfe said Friday he was concerned there were no bond conditions he could set, to reasonably assure the community's safety from Mark Jabben.
He agreed with prosecutors though, the law required one, and he set the bond at $50,000.
It's possible the 46-year-old Jabben could now be released for a second time since being accused in two shootings and alleged to have threatened another one.
Wolfe considered cases involving Jabben dating back to March 25, when he shot and killed his neighbor Kevin Battle. Fort Worth Police never charged Jabben though, saying he had claimed self- defense.
The case sparked public protests in Fort Worth. Battle's family has been told that the Tarrant County Criminal District Attorney's Office could consider presenting the case to a grand jury next month.
Police did arrest Jabben May 10, after another shooting call where a woman told paramedics Jabben held a gun to her back, shot her in the shoulder and hit her over the head.
He was released after posting a $4,000 bond, and on May 17 was accused of going to Carrollton and threatening to shoot another woman and take a child the two have together.
No witnesses testified Friday, but prosecutors did say the woman shot told them she did not believe Jabben was trying to kill her.
They also said they do not believe Carrollton police plan to file a case over the threat in their city.
If Jabben is released he will be required to stay from any of the alleged victims or their family members. He will be on house arrest, and be fitted with a GPS monitor.
Battle's fiancée, who was at the hearing Friday, said she was disappointed with the outcome.
"It's still not enough," said Talydia Adams. "I just want him in jail. Not out. Not out where he can do this to somebody else."
