Arrest Affidavit: Man Choked, Raped Woman In Deep Ellum
DALLAS (CBSDFW.COM) - After releasing a picture of a man they wanted to speak with regarding a rape in the Deep Ellum area, Dallas police have made an arrest.
Tips came pouring in Tuesday just hours after police released a photo of a then-unidentified man they called a "person of interest" in Saturday night's attack.
After investigating the leads police identified the suspect as 40-year-old Roy Gutierrez. Police received a warrant for his arrest and after finding him at the DART West End Transfer Station late Tuesday night took him into custody.
Two people contacted police after seeing a security camera photo CBSDFW.com posted Tuesday.
The arrest affidavit reveals in graphic detail how Gutierrez allegedly grabbed the victim's neck and dragged her behind a building at 301 Crowdus. Police she was choked until she nearly lost consciousness.
The report says she was assaulted despite desperate attempts to fight off the suspect.
Gutierrez has a prior arrest for aggravated sexual assault in 2007 and an arrest for burglary in 2000.
He was charged with Aggravated Sexual Assault and is being held in the Dallas County Jail on $100,000 bond.
