Check Technicality Means Hit & Run Suspect Will Stay In Jail Over Weekend
DALLAS (CBSDFW.COM) - A Grand Prairie teacher accused in the hit-and-run death of 6-year-old John Raidy is expected to spend this weekend in the Dallas County jail.
Tammy Lowe's attorney attempted to get her released Friday afternoon, after convincing a judge to reduce her bond to $125,000.
Cameron Gray arrived with checks in hand, but jail officials declined the payment over a technicality.
Gray now expects to get the matter resolved first thing Monday morning. "But for the grace of God, it'd be you or you or you. But for the grace of God, it'd be anyone," said Gray, who cast his client as a victim of chance in a tragic accident.
He declined to answer questions on why she failed to stop, after striking the young boy. "I can't get into that, but I have an answer for it later," he said.
A police affidavit shows one witness claimed Lowe had a green light when she passed the intersection and struck Raidy. Grand Prairie police, however, say they have surveillance video clearly showing the light had been red for a full 14 seconds.
New surveillance video released by the department shows Lowe walking into the station this past Tuesday with her husband, five days after the crash, to turn herself in. Investigators say she appeared distraught, as if she hadn't slept in days.
A police affidavit says she admitted to her involvement in the accident, but refused to a formal interview with police.
Friday afternoon she arrived at the Dallas County jail escorted by officers, and once again remained silent, refusing to acknowledge media.
