Additional Lawsuit Likely In Apparent Accidental Shooting
DALLAS (CBSDFW.COM) - A recent accidental shooting in New York similar to the one that killed a man in far north Dallas last year will likely mean an additional lawsuit.
25-year-old Michael Alcala died when an undercover Plano police officer says he accidentally pulled the trigger instead of turning on a flashlight attached to his service weapon. The drug sting back in October in Far North Dallas is followed by a similar incident this past weekend reported by the New York Post involving a man wounded by a cop in the Bronx. He was shot in the stomach, but will survive.
Dallas Attorney Les Weisbrod already filed a negligence suit on behalf of the family against the city of Plano, and now with this additional incident, he will likely to file an additional lawsuit against the manufacturer of the flashlight.

Weisbrod told KRLD, "It's becoming more apparent that this is a defective-designed product." He says the on switch for the SureFire X300 is too close to the trigger. A spokesman for the manufacturer told the New York Post that product is safe, prevents misidentification and saves police lives.
