Suspected Bank Robber To Stand Trial In Vallejo Officer Murder
FAIRFIELD (CBS/AP) -- A suspected bank robber charged with killing a Vallejo police officer will stand trial after a Solano County judge ruled that enough evidence exists against him.
38-year-old Henry Albert Smith Jr. will be tried for murder in the fatal shooting of veteran police Officer Jim Capoot.
Smith is also being charged with being a felon in possession of a handgun, and special circumstances that could make him death-penalty eligible.
Investigators testified that they found more than $3,000 and a mask in Smith's van, and that shell casings at the scene matched the suspect's gun, which was found in his pocket.
Capoot gave chase to Smith while responding to a Vallejo bank robbery. The officer was fatally shot in the back.
