Suspect In Oakland Killing Arrested During Smoking Violation
OAKLAND (CBS/AP) - Authorities said a man suspected of a slaying in Oakland was arrested after sheriff's deputies confronted him for smoking a cigarette in a prohibited area.
Franklin Bean, 30, is facing a murder charge in the Dec. 17 killing of Jeremy Johnson. The 25-year-old Johnson was shot outside a store in the city's Fruitvale district.
Authorities said Bean was arrested Friday after two sheriff's deputies spotted him smoking close to a bar in unincorporated Hayward.
A county ordinance prevents smoking within 20 feet of such businesses. The deputies were getting ready to cite Bean when a computer check turned up a warrant for his arrest in the Oakland slaying.
Oakland police said Bean has acknowledged shooting Johnson, but has said he acted in self-defense.
