Teen Stabbing Victim Sues San Jose McDonald's
SAN JOSE (KCBS) - A San Jose teenager who suffered several stab wounds outside a downtown McDonald's, is now suing the restaurant's owners.
On the night of June 9th, more than 50 people had gathered in the parking lot of the McDonald's at 3rd and San Carlos following a Music in the Park concert.
Jonathan Paredes, 17, said he and a friend went there on a late-night cheeseburger run, when suddenly someone demanded his iPod, and then stabbed him several times. The subsequent brawl left five people stabbed or injured. Paredes is now suing McDonald's owners for failing to provide adequate security.
Former prosecutor and San Jose legal analyst Steven Clark said there is a legal obligation for business owners to protect their customers.
"This is very similar to the type of analysis you'll see in the Bryan Stow case...where they're also alleging that Dodgers stadium was a dangerous place based on prior criminal activity," Clark explained.

Neighbors have complained that the downtown Music in the Park events have been a magnet for gangs. The restaurant owners, Rudy and Carmen Lemus, have not commented on the lawsuit, and so far no arrests have been made.
