San Jose Restaurant Banned From Selling Alcohol After Fatal Shooting
SAN JOSE (CBS SF) -- State officials on Friday said they have halted liquor sales at a San Jose restaurant after two shootings, one of them fatal, occurred there in less than a month.
The California Department of Alcoholic Beverage control posted a notice on Tuesday suspending the liquor license at Lu Restaurant indefinitely, officials said Friday.
The suspension, which took effect immediately, means alcohol sales are prohibited at the restaurant and the owner is required to transfer the license to a qualified person at another location, officials said.
The action comes after a fatal shooting on last Saturday, Oct. 24 that killed a San Francisco man, 34-year-old Michael Arcega.
Arcega, a rising real estate agent who worked in San Carlos, was shot at least once shortly before 2 a.m. in front of the restaurant at 1595 Monterey Highway, and pronounced dead at the scene, according to San Jose police.
State licensing officials said they learned after the shooting that a previous shooting had occurred on Sept. 26, injuring two victims, and that the restaurant's owner and employees did not report it.
Their failure to report the crime hindered the investigation and violated state law, officials said.
In addition, state officials said they discovered evidence of other license violations including nude entertainment on the premises, liquor sales after 11 p.m., excessive noise and live entertainment.
