East Palo Alto Parolee Arrested For Allegedly Threatening To Kill Roommate

SAN JOSE (CBS SF) -- An East Palo Alto man was arrested Thursday evening for allegedly repeatedly threatening to kill a San Jose resident he used to live with, police said.

Darnell Joseph Earby, 36, was arrested around 5:20 p.m. Thursday by San Jose police, East Palo Alto police, and a San Mateo County SWAT team.

San Jose police said they began looking for Earby -- a two-strike convicted felon -- after learning on Aug. 14 that he had threatened to kill his former domestic cohabitant a number of times, including on one occasion while holding a firearm. He had also allegedly threatened to participate in a shootout with police.

Earby was also wanted by the California Department of Corrections for violating parole, police said.

San Jose police located Earby around noon Thursday in the 900 block of Wilks Street in East Palo Alto and contacted city and county law enforcement for assistance.

According to police, Earby surrendered to the SWAT team readily and was booked into the Santa Clara County Jail without bail on two counts of criminal threats, one count of stalking and one count of burglary. All of the charges are felonies.
