San Jose Homeowner Shoots Suspected Burglar
SAN JOSE (KCBS) -- Police are trying to determine what exactly happened in an early Friday morning shooting in San Jose's Dry Creek neighborhood.
A homeowner shot a man suspected of burglarizing his home around 4:18 a.m. in the 1700 block of Patio Drive near Meridian Drive.
Police Sgt. Ronnie Lopez said when officers arrived they discovered a man shot in the torso lying in the back yard. He was then transported to the hospital with serious, but not life-threatening injuries.

According to Lopez the preliminary investigation indicated the homeowner was woken up by noise in his back yard where he then observed a male holding what appeared to be a handgun. The homeowner then discharged a firearm.
Lopez said the case is convoluted and officers are still trying to figure out if the suspect in fact was trying to break and enter the man's home and whether the suspect ever had a weapon.
Police are in the process of getting a warrant to search the house to see if there was any other motive.
