49ers Ahmad Brooks Accused Of Sexual Assault At Ray McDonald's Former San Jose Home
SAN FRANCISCO (CBS SF) -- San Francisco 49ers linebacker Ahmad Brooks has been accused of sexually assaulting a passed-out woman at former teammate Ray McDonald's house in San Jose, according to a published report.
TMZ reported Wednesday that the same woman who accused McDonald of sexual assault also accuses Brooks of assaulting her that same night, and says there is video evidence to prove it.
TMZ cited documents obtained on the case as saying the woman was at McDonald's home on December 14th, 2014 when she slipped and fell on the deck around his swimming pool, knocking herself unconscious for several minutes.
The woman claims the video shows Brooks "groped her person in a sexual manner" according to the report, and that McDonald then carried her up to his bedroom where he had sex with her without her consent.
49ers General Manager Trent Baalke issued the following statement Wednesday, "The San Francisco 49ers organization is aware of the media report regarding Ahmad Brooks. We were disappointed to learn of this matter and will continue to monitor the situation."
Prosecutors did not file charges against McDonald for the December incident, citing a lack of evidence. McDonald has filed a lawsuit against the woman, saying their sexual encounter was consensual and that she defamed him and intentionally interfered with his livelihood.
The woman's attorney, Gloria Allred, said Wednesday she had filed a motion to dismiss McDonald's lawsuit against her client based on a California law that protects those reporting alleged crimes from lawsuits. Allred also said the woman is counter-suing McDonald, alleging assault and battery, negligence, intentional infliction of emotional distress and false imprisonment - noting the district attorney has yet to make a final decision on prosecuting McDonald.
"She wants Mr. McDonald to know that she is not going to live in fear of him anymore," Allred said.
After he was accused, the 49ers cut ties with McDonald, citing a pattern of behavior by the defensive lineman. The Chicago Bears signed him to a one-year contract in March.
Legal expert Judge LaDoris Cordell says there are two possible explanations for why Wolf is suing in civil court.
"One is, it's not a good one, is that she's a gold digger and she's just out for money," Cordell said.
Judge Cordell says the other explanation is that because Wolf was unconscious she really didn't know she was a victim, and that it will likely come down to whatever is on the surveillance video.
