Oakland Rapist Sentenced to 24-Year Prison Term
OAKLAND (CBS SF) - A man was sentenced Wednesday to 24 years in state prison for raping a woman in East Oakland last year and then fleeing from a police officer who tried to arrest him two days later.
Prosecutor Eddie Vieira-Ducey said Brian Young, 32, raped the victim early the morning of July 28, 2011, in a van near 88th Avenue and Hillside Street.
The victim had met Young for the first time when she and a friend were at a bar earlier that evening, and had exchanged numbers with him, Vieira-Ducey said.
After having a disagreement with her friend, the woman agreed to meet Young at 88th and Hillside Street, according to the prosecutor.
When the woman arrived, Young, who is 6 feet 5 inches tall and weighs 250 pounds, allegedly opened the door to the woman's car, pulled her out by her neck, dragged her to a van parked nearby and threw her inside.
Over the next two hours, defendant Young alternated between normal conversation and making threats, and eventually raped her, Vieira-Ducey said.
After the rape, Young took the woman's purse, wallet, cellphone, car keys and identification, saying he wanted to "check up on her" afterward," Vieira-Ducey said.
Young left the woman in the van and drove off in her car, he said.
Not knowing where she was, the woman tried to get help but was unsuccessful, according to Vieira-Ducey.
She began walking down MacArthur Boulevard at about 5 a.m. and eventually found a city worker, who took her to the Oakland police substation at the Eastmont Mall, where she reported the rape, he said.
Two days later, the officer who had taken the woman's rape report saw her car parked in the area of 87th Avenue and E Street, not far from where the rape occurred, Vieira-Duecy said.
Young walked up to the car an hour later, got in and drove off. When officers tried to stop the car, Young led them on a five-mile pursuit down International Boulevard onto San Leandro Street, according to Vieira-Ducey.
Young was arrested after he crashed into a parked car and the front porch of a home, the prosecutor said.
During Young's trial, jurors heard from two of Young's prior alleged sexual assault victims. They also were presented with physical evidence, such as Young's DNA in the form of his sperm on the victim's vaginal swab.
On May 14, jurors convicted Young of forcible rape, second-degree robbery, false imprisonment and felony evading a peace officer.
Alameda County Superior Court Judge Joan Cartwright sentenced Young Wednesday after first denying a defense motion for a new trial.
Cartwright granted a motion by Young asking to fire his attorney, Assistant Public Defender Romany McNamara, so he represented himself during the sentencing portion of Wednesday's hearing.
