No Charges For San Rafael Home Invasion Suspects

SAN RAFAEL (CBS SF) -- The Marin County District Attorney's Office has decided not to file charges against three San Rafael home invasion robbery suspects because there is insufficient evidence.

Deputy District Attorney Tom Brown said Wednesday morning the case remains under investigation by the San Rafael Police Department.

Police arrested Frank Lee Gray, 23, of Oakland, Khiry Jefferson, 21, of San Rafael, and 19-year-old Kenneth Wayne Woodard, of San Rafael, in connection with the robbery of a home on Sea Way in east San Rafael on Friday evening.

A female resident said several men forced their way into her home and robbed her at gunpoint, police spokeswoman Margo Rohrbacher said.

The suspects were arrested after a manhunt Friday evening. All were booked into Marin County Jail and being held on $75,000 bail. Police said a fourth suspect was at large.

Gray and Woodard have since been released from jail, but Jefferson remains in custody on a parole hold, Brown said.

On Tuesday, Rohrbacher said police wanted to assure residents that the robbery was not random and that investigators were considering "possible links between the victim and the suspects and potential motivations for the crime."

Police received the report of the home invasion robbery on Sea Way at 5:30 p.m. Friday. A woman told police that several men, including one armed with a gun, forced their way into her home, robbed her and then fled in a car, police said. The victim was not injured.

Minutes after the call came in, an officer on Third Street saw a car carrying four men matching descriptions of the robbers.

The officer saw the passengers ducking down to hide. As officer was following the car down Union Street, the driver stopped abruptly and all four suspects jumped out and ran away, police said.

Two were caught and taken into custody while a third ran into an apartment complex at 302 Fourth St. Witnesses told police the fourth suspect was seen running north on Union Street, according to police.

The area was shut down as police searched for the two remaining suspects.

The third suspect was found hiding under a car in a parking lot and was taken into custody at 7:50 p.m., police said.

The search for the fourth suspect was called off at 9:30 p.m.

Police described the at-large suspect as a black man about 20 to 25 years old, standing from about 5 feet 8 inches to 5 feet 10 inches tall with short hair that looks almost shaved. He was wearing blue jeans and tennis shoes.

About 50 officers participated in the search, including SWAT teams from the San Rafael Police Department, Marin County Sheriff's Office and Twin Cities police. A California Highway Patrol officer and a Novato police K-9 unit were also called in.
