No Charges Against San Jose Teacher Accused Of Sex Assaults
SAN JOSE (BCN) -- The Santa Clara County District Attorney's Office declined to file charges against a San Jose substitute teacher arrested on suspicion of sexually assaulting students.
Jayanthum Kapasi, 64, of San Jose, works for the Franklin-McKinley School District and might also have worked for the San Jose Unified School District.
He was most recently assigned to McKinley Elementary School, according to police.
Amy Cornell, a spokeswoman for the district attorney's office, said the case was sent back to the Police Department for further investigation.
"We haven't filed charges yet against Mr. Kapasi, but that doesn't mean we never will," Cornell said. "At this time, though, the case is not in a place where it can be criminally prosecuted without supplemental information."
She said Kapasi was released from custody because charges were not filed within the three-day period the district attorney's office has to review in-custody cases.
