California Supreme Court May Again Delve Into Prop. 8
SAN FRANCISCO (KCBS) -- The State Supreme Court is going to decide whether to jump back into the legal issues surrounding the Proposition 8 same sex marriage initiative.
The Ninth Circuit Court of Appeals wants to know whether Prop. 8 supporters have legal authority to defend the ballot measure. The question of certification, or "standing," as it's called, could have a huge impact on how the Ninth Circuit deals with the legality of the same sex marriage proposition.

In a recent meeting with reporters, Justice Tani Cantil-Sakauye said it's up to the state's highest court to interpret the initiative called Prop. 8.
"We have to determine what it means, so we look at the words, which are the best indicators, in addition to context, and that's what we're trying to interpret - the word and will of the people," said Cantil-Sakauye.
Most analysts expect the Supreme Court to eventually decide the legality of Prop. 8
