Appeals Court Upholds Alameda County Gun Show Ban
PLEASANTON (CBS / AP) -- An appeals court has upheld Alameda County's ban on gun shows on government property.
But in issuing its decision Monday, the 9th U.S. Circuit Court of Appeals gave challengers of the ban a chance to rewrite their lawsuit in light of two significant U.S. Supreme Court rulings confirming gun ownership as a fundamental right.
Attorney Don Kilmer, who represents organizers of gun shows, said he and his clients are undecided over whether to appeal the decision or continue fighting the ban in a trial court with a rewritten lawsuit.
Russ and Sallie Nordyke originally filed their suit in 1999 months after Alameda County banned gun possession on county property. The ban effectively shut down gun shows at the county's fairgrounds.
The Nordykes claim the ban violates their Second Amendment gun rights.
