At the time he was tested on Saturday night, CHP officers say Michael Tubbs, 24, had a BAC of .137.
He's known as a true son of Stockton, even the subject of a documentary with the same name about his historic campaign.
The CHP says Tubbs was pulled over at 3:30 a.m. for speeding on southbound Highway 99 near Hammer Lane.
Tubbs is the youngest official ever to be elected in Stockton. His run for office was an inspiration to Stockton's youth, and even talk show icon Oprah Winfrey endorsed the campaign.
Tubbs released a statement, saying in part, "While I am embarrassed by my mistake, I am committed to using the experience to further my service to this community."
"This is an opportunity for him to go back, whether that's college kids, his age, he's 24, folks that are his age, all the way down to middle school and high school letting them know that driving under the influence is not OK,: said Aaron Wade with Mothers Against Drunk Driving.
Mayor Anthony Silva spokes of redemption when CBS13 asked him about the case.
"Stockton is a city of second chances, so I profoundly believe in second chances, you know we're only human. But the most important thing is is that no one was seriously injured," he said.
