Man Heads Back To Prison After 11th DUI Arrest

SOUTH SACRAMENTO (CBS13) -- A judge finally found a way to get a DUI driver off the road for a long time to come.

His latest DUI crash took place on Interstate 80 just behind IKEA. His mother says that she has dealing with his alcoholism since he was a teenager.

"What is the real answer honey? If I would knew it I would have started 20 or 30 years ago," said the suspect's mother.

The suspect's, mother goes by the name "Pinky", and she lives in a South Sacramento trailer park.

Pinky's son, 46-year-old Jay Wayne Porterfield, should be here too, but he's on his way to prison…again.

"What am I suppose to do? Take him by the ear and say 'you can't do that?'" said Pinky.

"So this guy obviously has an alcohol problem," said Yolo County Chief Deputy DA Jonathan Raven.

Yolo County officials tell CBS13 last June Porterfield was riding a motorcycle on Highway 50 at the Interstate 80 transition when he crashed his bike.

"Somebody says he went flying off the bike," said Pinky.

He was found on the side of the road.

"The cops found him in the ditch, yes," said Pinky.

Police say Porterfield was drunk, with an excuse.

"He says a six pack. His blood alcohol level showed a lot more," said Raven.

The DA says since 1989 this is the 11th time Porterfield he's been arrested for DUI, mainly in Sacramento County.

"We've come along way, but not nearly enough," said Raven.

They say he's been in and out of jail and prison, but never served serious time because no one has ever been hurt. The DA says he's ticking DUI bomb.

"We need to ask our legislature. We need to go to congress in DC and we need to tell them we need stricter laws," said Raven.

"He drinks too much, like a lot of people," said Porterfield's friend Patrick Carter.

The suspect is admired by his neighborhood.

"I love him. He's a good man. I hate to see him go down again," said Carter.

"And of course he let me down, but the judge did too," said Pinky.

The judge gave him the maximum: six years in state prison.

"We don't want this guy on the streets. Whether it's a problem or not he's going to kill someone," said Raven.

Porterfield received a six-year prison sentence because he was arrested three times or more within a 10 year period for DUI. The judge also made him sign a document saying that if he kills someone during a DUI accident the charge will be murder.
