Family Of Dead Baby, Father Outraged By Suspect's Claim

SACRAMENTO (CBS13) - The family of a father who was shot and killed along with his seven-month-old son is outraged tonight at what a suspect told CBS13 yesterday.

Richard Noguera told us he's innocent and he'd take a lie detector test to prove it. He also said he wants to face the family to tell them he's innocent. That's the statement that really upset them.

"Who would ever admit to it? Who would admit to killing a baby?" said baby Sean's mother, Monique Dela Cruz.

As a grieving family faced the second suspect in court, they expressed their anger to CBS13 that he had nothing to do with the murder of Sean Aquitania Jr. and his father.

"I can look at them physically in their eyes and tell them that I did not kill your child or your fiancé," said Noguera.

"If I did have the opportunity to look him in the eye, I would tell him that my son died in my arms with a shot wound to the head," said Monica. "He died in my arms, and I visit my son and Sean at the cemetery."

Noguera is now charged as the shooter in a brutal double-murder that made national headlines four years ago.

"We're finally gonna get some rest on what happened," said Sean Aquitania Sr.'s mother, Sarah Aquitania.

Noguera's family has hired a private attorney who questions DNA evidence detectives say they have, linking his client to the crime scene: a South Sacramento home where a robbery was in progress and the victims stopped by for a visit.

"I'm positive that they don't have any DNA results back yet," said. "It just takes a lot longer to do that. It's not like CSI when they get them the next day."

Noguera did not enter a plea today. His attorney asked for more time because he just got this case and wants to review the details. He's due back in court on Oct. 27. Investigators are still looking for a third suspect in this case.
