Call Kurtis: What Should I Do If The Furniture Delivered Has Issues?

A Lincoln woman bought a new custom made sofa set but she started seeing problems right away. When she couldn't get the company to return her calls, it was time to call Kurtis.

She bought the sofa from Furniture For Less in Sacramento.

But says she didn't get what she ordered.

"Here you almost completely sink in," says Anna Bush.

It's not only uncomfortable, Anna says the sectional she ordered from Furniture For Less in September is also missing pillows and ripped within the first few months.

And it's the second couch she's received. The first one they delivered was the wrong size.

"They show up and it's completely wrong," says Anna.

And the chaise they delivered has different colored legs, not matching the black legs on the couch.

"The legs are wide and a brown color," says Anna.

So far she's only paid a $500 deposit. The company promised to fix the problems but in four months, they haven't.

"It's really frustrating as a consumer," says Anna.

"If it's clearly not what you ordered, then you shouldn't accept delivery of it because you didn't order it," says Russ Heimerich, California Department of Consumer Affairs spokesperson.

Heimerich says once you sign for furniture during delivery, often you're saying you accept it as is.

But Anna says she never signed anything.

Manuel Cervantes, the owner of Furniture For Less, blamed the issues on the manufacturer, which he says went out of business.

"I never got those legs from the company," says Cervantes.

He denied getting Anna's calls but he's willing to make good now.

"I'm totally responsible for it because she bought it from me and I'm willing to take care of it. That's not a problem, that's not a problem at all," says Cervantes.

Cervantes agreed to take back the sofa set and return Anna's $500 deposit.

She now plans to buy a sofa somewhere else.

"I would be extremely happy to not have to worry about a couch anymore," says Anna.

Just last week, Furniture For Less picked up Anna's old sofa set and refunded her $500.

Anna tells us she has since bought a new couch at another store.

It's always a good idea to check with the Department of Home Furnishings and Thermal Insulation to see if a company is licensed.
