Call Kurtis: Should I Have to Leave CA to Get My Lasik Lifetime Plan Honored?
WEST SACRAMENTO (CBS13) — West Sacramento dad David Weller had Lasik surgery and paid extra in case he had to have the surgery again. When his vision started failing, he says he was told he'd have to leave the state to get it fixed because the company is no longer in California.
David cannot clearly see his 3-year-old son, Sterling from 15 feet away even after investing in Lasik surgery six years ago.
"I can't make out his face or distinctive features. If there were three kids lined up I couldn't pick my own kid out," he said.
David had Lasik surgery in 2009 at Lasik Plus in Roseville. He paid an extra 399-bucks for a lifetime acuity plan. It says if his "vision drops" he will be treated at no additional cost.
"They're not holding up their end of the bargain," he said.
Lasik Plus pulled out of California and David says the company told him he has to travel out of state to Arizona, Utah, or Oregon for more treatment.
"This is not what they promised me," said David.
David is not alone in trying to get the services he paid for from LasikPlus
A valley patient wrote online, "They basically told me I am up a creek. The closest office is in Scottsdale, AZ or Salt Lake City, Utah.
"I think it's very cut and dry," said Consumer Attorney Brooks Cutter who says if LasikPlus offered the lifetime plan in California, it has to honor it in California.
"They can't just decide we're just shutting down in California and it's now going to be on you to travel, he said.
We reached out to LasikPlus CEO Craig Joffe who confirmed the company left California for financial reasons.
He blamed David's troubles on a contract issue his company is having with a California eye doctor.
Joffe confirmed thousands of Californians paid for this lifetime acuity plan and he promised to find a place in California to service those customers. He held true to his word inking a deal with Laservue Eye Centers.
However, David says after going to Laservue, they told him he is not a candidate for more Lasik. Instead they say he needs a costly surgery that is not covered. Another eye doctor told him he is a candidate for Lasik. When we contacted Joffe about this, he quit returning our calls.
David is tired of waiting, and has filed a case against LasikPlus in small claims court.
