Tolbert-McGhee's defense attorney Tim Dawson says his client wasn't the shooter. Instead, during the trial he pointed to Tolbert-McGhee's now-dead identical twin brother.
The jury in Westmoreland County reached their verdict shortly after 2 p.m. Friday.
"I told him to expect the worst and the worst arrived," Dawson says.
In his closing argument, Dawson told the jury the surveillance videos show a shooting and the videos certainly cannot identify anybody. He also claims there's no evidence against his client, along with no evidence of a motive.
Assistant District Attorney Peter Caravello countered in his closing saying as for a motive, it may never be known. He went on to say there was physical evidence of bullets and busted glass.
Regarding the mistaken identity claim by the defense, Caravello told the panel it doesn't matter if the two looked alike.

"I give credit to the prosecution they were able to convince the jury that the one identical twin committed the murder rather than the other one," he says.
