Parents Of Infant Who Died At Unlicensed Daycare Sue Owners
HAMPTON TOWNSHIP (KDKA) -- A local couple was served with a lawsuit Wednesday after a 2-month-old baby, being cared for at their home, was found unresponsive.
Parents of the baby say the couple was operating an unlicensed daycare out if their Hampton Township home at the time of the baby's death.
It was Nov. 29, 2012 when Leanne Talik dropped her 2-month-old son, Connor, off at the home of Edward and Lynn Schmidt.
According to the civil lawsuit, Conner was put on his stomach for a nap in an upstairs bedroom of the house around 8:30 that morning.
More than two hours later, his caretaker, Lynn Schmidt, checked on him only to find him not breathing and unresponsive.
The baby was rushed to UPMC Children's Hospital where doctors tried to revive the baby with his mother and father watching, but the newborn was declared dead right before noon.
No one answered at the East Hardies Road home Wednesday evening, and neighbors didn't want to talk about the baby's death on camera, but did say they're aware of the daycare run out of the home.
According to the lawsuit, the daycare is unlicensed, unregistered and is not in compliance with the Department of Public Welfare.
It goes on to say the baby died because he wasn't able to breath and suffered cardiac arrest.
The Taliks say their baby's death was due to negligence when Lynn Schmidt placed the 2-month-old on his stomach and then put him in an upstairs bedroom that wasn't regularly checked.
