Orie Melvin Re-Sentenced
PITTSBURGH (KDKA) -- Judge Lester Nauhaus has re-sentenced former Pennsylvania Supreme Court Justice Joan Orie Melvin to three consecutive one-year terms of house arrest "out of an abundance of caution," fearing that his original three-year sentence may not have been technically correct.
Also at today's, hearing Melvin was ordered to pay a total of $127,000 for fines and court costs, and she agreed to pay her sister Janine Orie's restitution costs.
She will also serve her community service obligation at the Jubillee Kitchen in Pittsburgh's Hill District.
"I think that the judge's concern was that the three-year, flat home detention sentence could be construed as a state sentence even though it was not being served in the state institution which would then make the state parole board in charge of whether or not justice Melvin, Joan Melvin now, would be able to be released," defense attorney James DePasquale.
Her attorney, though, asked the judge to reconsider his order for a written apology to court staff, claiming that could violate her fifth amendment rights.
The judge said he would take that matter under advisement.
Orie Melvin's sister, Janine Orie, was sentenced to one year of house arrest.
