New Charges Filed Against Lifeguard Supervisor Accused Of Sexual Assault
PITTSBURGH (KDKA) – There was surprising testimony in court Thursday during a hearing for a former lifeguard supervisor accused of forcing a teenage employee to have sex with him.
Michael Kelly was 25-years-old when he was accused of having sex with a 16-year-old lifeguard in a storage shed at the Upper St. Clair Recreation Center where he was head lifeguard.
There are allegations of more inappropriate contact with her at his home, but under cross-examination, the alleged victim, now 19, broke down and admitted she consented to sex.
"Everything that happened, she was agreeable to, and this was not a situation where, as the complaint states, there was any forcible compulsion or threat of compulsion," said defense attorney Charles Porter.
The sexual assault charges were dropped. But Kelly was held for trial on corruption of minors and endangering the welfare of a child charges.
Meantime, new charges were filed. These charges say he raped another lifeguard at the same rec center.
"I have not had the ability to discuss them, either with my client or even review them in any great detail," said Porter. "We'll certainly look at those and be prepared to defend them as appropriate."
Kelly had been free on $100,000 bond for the first set of charges. But now he's back in the county jail under $200,000 bond on the latest charges.
As for the second alleged victim, we don't know her age, but it doesn't appear she's a juvenile.
She told police she was dating Kelly, they broke up and he allegedly forced himself on her after the break up.
