Jury Deliberating In Retrial In 2012 Slaying Of Pregnant Woman
BEAVER, Pa. (KDKA) - Jury deliberations are underway in the case of a man on trial for the second time in the 2012 slaying of a pregnant woman and her unborn child.
Marlin "Twin" Kelly, 31, of Pittsburgh is charged in the October 2012 shooting deaths of 19-year-old Conekeia Lynn "Coco" Finney and her unborn daughter.
Police say accused drug dealers Kelly and Tyrone Fuller went to Steven Murray's apartment in Ambridge planning to rob him in a dispute over stolen heroin.
Murray's girlfriend Finney answered the door. Finney was wearing a dark hoodie and was shot and killed mistakenly. Her 7-month-old unborn child died also.
Kelly and Fuller were arrested but didn't go to trial until 2014. A jury found Kelly guilty of second degree murder and Fuller plead guilty to third degree murder.
But the defense attorney appealed the conviction and granted a new trial due a jury selection issue. A new jury was seated and the second trial began in February.
This time Tyrone Fuller didn't testify against Marlin Kelly. A witness who testified in the first trial died from a drug overdose, but his testimony was read to the jury.
In the first trial, it took a jury 9 hours to find Kelly guilty. They deliberated exactly nine hours Thursday and Friday but could not reach a verdict.
The judge told them to come back and try again on Monday.
